As a user of Eventful Sunday, whether an organizer or an attendee, you are entering into an agreement with CubeQ Analytica. This platform is accessible through various digital interfaces, including but not limited to:

• The official mobile applications are available for download on Android (Google Play Store) and iOS (Apple App Store) devices. 

• Any other digital or physical services provided under the brand name “Eventful Sunday” or through partnerships affiliated with CubeQ Analytica. 

Eventful Sunday serves as an intermediary between individuals or entities that organize events (referred to as “Organizers”) and individuals who attend or participate in events (referred to as “Attendees”). It provides the technological infrastructure necessary for event listing, marketing, ticket sales, attendee management, and event discovery across various categories, such as music, theatre, sports, business seminars, community gatherings, and cultural festivals.  

Throughout these Terms and Conditions, the term “Eventful Sunday” will be used to collectively refer to the entire suite of Services, including but not limited to the website, mobile application, software, APIs, and all related tools and functionalities made available by CubeQ Analytica. 

2.2 “User” 

The term “User” refers to any individual, entity, or organization that accesses, interacts with, or utilizes any portion of the Eventful Sunday platform, including both the website and mobile applications. Users can interact with the platform in various capacities, and depending on their specific use case, they may fall into one or more of the following categories: 

• Organizers (as defined in section 2.3) 

• Attendees (as defined in section 2.4) 

• Visitors: This refers to individuals who browse the Eventful Sunday website or mobile app without registering for an account. Visitors can view event listings, browse through event categories, and access limited features without creating a user profile. However, certain functionalities, such as booking tickets or creating events, may be restricted to registered Users only. 

• Registered Users: A Registered User is someone who has created an account on the platform by providing their personal information, such as their name, email address, and phone number. Registered Users can access a broader range of features, including event creation (for Organizers) and ticket purchases (for Attendees). 

Users are responsible for their actions and interactions on the platform. They must abide by the platform’s rules, including adhering to the Terms and Conditions, Privacy Policy, and any applicable laws. 

2.3 “Organizer” 

An “Organizer” refers to any individual, company, or organization that uses the Eventful Sunday platform to create, promote, manage, and/or host events. Organizers are responsible for ensuring that the event details they provide (such as the event title, description, venue, date, ticketing options, etc.) are accurate, complete, and up to date. Organizers have access to specialized features and tools designed to help them: 

• Create Events: Organizers can list new events, providing detailed descriptions, images, pricing tiers, schedules, and other relevant information. They can specify the type of event (e.g., music concert, theatre performance, charity fundraiser) and determine whether the event will be open to the public or restricted to certain audiences. 

• Manage Events: The platform allows Organizers to manage all aspects of their events, including tracking ticket sales, attendee demographics, and event logistics. They can also update event information, communicate with attendees, and handle event cancellations or postponements. 

• Ticketing and Payment: Organizers can sell tickets directly through Eventful Sunday, utilizing the secure payment processing options provided by the platform. They are responsible for setting ticket prices and adhering to local tax laws or any other legal requirements associated with ticket sales. Organizers also manage refund policies and are accountable for issuing refunds in case of cancellations or changes to the event. 

• Marketing and Promotion: The platform offers Organizers tools to promote their events, such as integrating social media, sending email campaigns, and targeting potential attendees based on their preferences or location. Organizers can also use built-in analytics to monitor the effectiveness of their promotional efforts. 

Organizers are held to a high standard of accountability, as their events impact the experiences of Attendees. They must comply with all legal, safety, and ethical standards relevant to the events they are hosting.  

2.4 “Attendee” 

An “Attendee” refers to any individual or entity that uses Eventful Sunday to discover, browse, book, attend, or participate in events hosted or promoted through the platform. Attendees can interact with the platform in a variety of ways, including: 

• Discovering Events: Attendees can explore events based on categories, locations, or personal preferences. They may use advanced search filters to find events that match their interests (e.g., music concerts, comedy shows, business seminars, cultural festivals). The platform also provides AI-powered recommendations tailored to their preferences, making event discovery more personalized. 

• Booking Tickets: Attendees can purchase tickets to events directly through the platform using the secure payment gateway. The platform ensures that ticket purchases are safe, and Attendees receive electronic tickets via email or mobile app, often in the form of QR codes for easy event check-in. 

• Attending Events: Once tickets are purchased, Attendees are responsible for adhering to the Organizer’s terms and conditions for each event. This may include rules related to refunds, cancellations, behavior at the event venue, or specific health and safety protocols (e.g., COVID-19 restrictions, venue capacity limits). 

• Engagement with Organizers: Attendees can interact with Organizers through the platform by submitting inquiries, providing feedback, or raising concerns. Eventful Sunday also offers Attendees the option to bookmark events, share event details with friends, and access customer support if they encounter issues with ticket purchases or event details. 

As an Attendee, your experience on the platform is essential, and Eventful Sunday is dedicated to providing a seamless and secure process for browsing, purchasing, and attending events. While Eventful Sunday facilitates the transaction and communication between Organizers and Attendees, the ultimate responsibility for the event lies with the Organizer.  

2.5 “Services” 

“Services” refers to all functionalities, features, tools, and resources provided by Eventful Sunday through its website, mobile applications, and other related platforms. These Services include, but are not limited to: 

• Event listing, creation, and promotion tools for Organizers. 

• Ticket purchasing, event discovery, and booking features for Attendees. 

• Secure payment processing for ticket sales. 

• Personalized event recommendations based on user preferences and interests. 

• Event check-in solutions via QR codes for easier management of attendees. 

• Communication features between Organizers and Attendees, including chatbot support, customer service, and event notifications. 

By participating in any aspect of the Eventful Sunday platform, Users, Organizers, and Attendees agree to abide by these Terms and to use the Services only for lawful and intended purposes.

By accessing, using, or interacting with the Eventful Sunday platform (including the website, mobile applications, and any associated services), you are entering into a binding agreement with CubeQ Analytica, the operator of Eventful Sunday. This agreement requires that you fully understand, agree to, and comply with the Terms and Conditions laid out in this document, as well as any applicable laws, rules, and regulations that may govern your use of the platform.  

These Terms apply to all users of the platform, including: 

• Organizers who use the platform to create, manage, and promote events. 

• Attendees who use the platform to discover, book, and attend events. 

• Visitors who browse the platform without registering but may still interact with event listings and other non-restricted content. 

Acceptance of these Terms is a condition of your use of the platform. If you do not agree to any of the provisions in these Terms, you must immediately cease all access and use of the Eventful Sunday website, mobile applications, and any related services. Continued use of the platform signifies your ongoing acceptance of these Terms.  

3.2 Binding Nature of Agreement 

When you use Eventful Sunday in any capacity, whether as an Organizer or Attendee, you are confirming that you have read, understood, and agree to be legally bound by these Terms. This binding agreement between you and CubeQ Analytica ensures that both parties understand their respective rights, obligations, and responsibilities. Failure to comply with these Terms may result in the termination of your access to the platform, cancellation of events, or other actions as deemed necessary by Eventful Sunday to protect the integrity of the platform and its users. 

For those acting on behalf of an organization, company, or other legal entity, you represent and warrant that you have the full authority to bind that entity to these Terms. This includes the responsibility to ensure that all individuals using the platform under your organization’s account comply with these Terms. Should any of your authorized users fail to adhere to these Terms, you or your organization will be held accountable for their actions.  

3.3 Electronic Consent 

You acknowledge and agree that by using Eventful Sunday, you consent to the use of electronic means to complete these Terms, including: 

• The formation of a legally binding contract between you and CubeQ Analytica. 

• Receiving all disclosures, notices, and communications electronically. These may be delivered via email, mobile notifications, or directly through the platform interface. 

You waive any rights or requirements under laws or regulations in any jurisdiction which require an original (non-electronic) signature or the delivery or retention of non-electronic records, to the extent permitted under applicable law. 

3.4 Modifications to the Terms

• Venue regulations, safety standards, and any local health guidelines (e.g., COVID-19 protocols). 

• Data privacy regulations, such as the General Data Protection Regulation (GDPR) for users in the UK and European Economic Area (EEA). 

3.6 Termination of Access 

Eventful Sunday reserves the right to suspend, limit, or terminate your access to the platform at any time if you are found to be in breach of these Terms or if your behavior negatively impacts the platform or other users. This may include, but is not limited to: 

• Misuse of the platform for fraudulent purposes. 

• Violation of the rights of others, including intellectual property rights. 

• Harassment, abuse, or unethical behavior towards other users (both Organizers and Attendees). 

• Attempting to hack, exploit, or disrupt the technical functionalities of the platform. 

Termination may occur with or without notice, and Eventful Sunday is under no obligation to restore your access once it has been revoked. Additionally, depending on the severity of the violation, legal action may be taken by CubeQ Analytica to protect its rights and the rights of other users. 

3.7 Additional Terms for Organizers 

If you are using Eventful Sunday as an Organizer, you agree to additional obligations regarding the management of your events. By creating an event on the platform, you confirm that: 

• You have the right and legal authority to host and promote the event. 

• All event information you provide (including venue details, ticket prices, and event descriptions) is accurate and up-to-date. 

• You will ensure that all events comply with local laws and safety regulations, and that appropriate measures are in place to protect attendees. 

• As an Organizer, you are responsible for all aspects of the event, including: 

• Refund Policies: You must establish and clearly communicate your refund and cancellation policies for attendees. 

• Event Changes or Cancellations: If an event is canceled or modified, you are responsible for notifying attendees promptly and issuing any necessary refunds. 

• Legal Compliance: Organizers must ensure their events adhere to all applicable laws, including any local health regulations, safety protocols, and intellectual property rights. 

Failure to comply with these additional obligations can result in the suspension or termination of your Organizer account and may lead to legal action if warranted. 

3.8 Additional Terms for Attendees 

If you are using Eventful Sunday as an Attendee, you agree to follow all applicable rules and regulations when purchasing tickets and attending events. By booking a ticket or registering for an event, you confirm that: 

• You will provide accurate personal information during the ticket purchase process. 

• You will comply with all event-specific policies set forth by the Organizer, including any safety, behavioral, or legal requirements for attendance. 

• You understand that Eventful Sunday acts as an intermediary between you and the Organizer and is not responsible for any issues related to the event itself (such as cancellation, changes in venue, or event quality). 

As an Attendee, you also acknowledge that: 

• Ticket Purchases: All ticket sales are subject to the Organizer’s refund and cancellation policies. You should review the terms of each event before purchasing tickets, as some events may have strict no-refund policies. 

• Behavior at Events: Attendees must follow all instructions from the event Organizer or venue staff during the event. Any violations of these rules may result in ejection from the event without a refund. 

3.9 Agreement to Data Usage 

By accepting these Terms, you also agree to the data collection and usage practices outlined in our Privacy Policy. This includes how we collect, store, and use your personal information while you use the platform. Eventful Sunday is committed to protecting your privacy, and our data practices are designed to comply with all relevant data protection laws, including GDPR for users in the UK and Europe. 

Users may opt out of certain data practices, such as receiving promotional communications, by adjusting their account settings or contacting Eventful Sunday’s customer support team.

4. User Accounts

To access certain features and fully utilize the Eventful Sunday platform, both Organizers and Attendees may be required to create a User Account. A User Account is essential for participating in key functionalities of the platform, including but not limited to: creating events, purchasing tickets, managing bookings, and receiving personalized event recommendations. This section explains the conditions under which you must create and maintain a User Account, your responsibilities in managing it, and the platform’s expectations of your conduct while using the account.  

4.1 Account Creation and Registration 

When creating an account on Eventful Sunday, you will be prompted to provide certain information, which may include but is not limited to: 

• Your full name 

• A valid email address 

• A phone number for contact purposes 

• A secure password 

• Additional profile details, such as your location or preferences for event categories (optional) 

For Organizers, additional information may be required, such as business registration details, a valid payment method for receiving funds from ticket sales, and other relevant organizational data. 

Upon submitting your information, you confirm that the details you have provided are: 

• Accurate: You agree to provide true, complete, and up-to-date information. If any information changes (e.g., your email address or phone number), you are responsible for updating your account profile to reflect the current and accurate information. 

• Current: It is essential that the information provided is current, particularly for communication purposes, as we may send you notifications about event updates, ticket purchases, and platform-related announcements. 

• Complete: You must ensure that all required fields are fully completed during the registration process. Incomplete or false information may result in the suspension or termination of your account. 

Failure to provide accurate, current, and complete information may result in the inability to access certain features of the platform or lead to the cancellation of transactions, events, or tickets. 

4.2 Account Eligibility 

In order to register for a User Account, you must meet the following eligibility criteria: 

• Minimum Age Requirement: You must be at least 18 years old to create an account on Eventful Sunday. If you are under 18, you may only create an account with the consent of a parent or legal guardian, who agrees to be bound by these Terms and assumes responsibility for your activities on the platform. Eventful Sunday reserves the right to request proof of age or parental consent when deemed necessary. 

• Legal Capacity: You affirm that you are fully capable of entering into a binding legal agreement. This means you are not under any legal restraints, such as bankruptcy, mental incapacity, or other legal restrictions that would prevent you from using the platform in compliance with these Terms. 

• Residence in an Eligible Jurisdiction: You must reside in a jurisdiction where Eventful Sunday’s services are legally permitted. By registering, you confirm that your use of the platform does not violate any local, regional, or national laws or regulations applicable to your location. 

4.3 Account Security 

Maintaining the security of your User Account is your responsibility. Eventful Sunday takes security seriously and implements industry-standard practices to protect your data, but we rely on users to follow basic security protocols to safeguard their accounts. 

• Password Confidentiality: During registration, you will create a password to secure your account. You agree to keep your password confidential and not share it with anyone else. If you believe that your account has been compromised or that someone else has access to your login information, you must notify Eventful Sunday immediately via support@eventfullsunday.co.uk.  

• Account Sharing Prohibited: You agree that your User Account is personal to you and may not be shared, sold, transferred, or otherwise distributed to any third party. Allowing unauthorized individuals to access your account could lead to the suspension or permanent termination of your account. 

• Strong Password Practices: We recommend that you use a strong password, consisting of a combination of letters, numbers, and symbols, and regularly change your password to enhance account security. Avoid using easily guessable information, such as birthdays, common words, or sequential numbers, as your password. 

4.4 Responsibilities for Account Use 

As the account holder, you take full responsibility for all activities that occur under your account. This includes any actions taken by third parties who may have accessed your account (with or without your consent). You agree to: 

• Monitor Account Activity: You must actively monitor the activity on your account to ensure that all transactions, bookings, or actions taken align with your intentions. You are responsible for regularly reviewing your account to detect any unauthorized or suspicious activity. 

• Accurate Representation of Identity: You are responsible for ensuring that your identity is accurately represented in all interactions on the platform. Impersonating others or providing false details about your identity, role, or authority (e.g., claiming to represent an organization when you do not) is strictly prohibited. 

• Compliance with Local Laws: You agree to use your account in compliance with all applicable laws, rules, and regulations. Any illegal activity conducted through your account, including fraud, misrepresentation, or violation of intellectual property rights, will result in the immediate termination of your account and may be reported to relevant legal authorities. 

• Organizational Accounts: If you are registering an account on behalf of a company, organization, or other legal entity, you confirm that you are authorized to act on behalf of that entity. You assume responsibility for ensuring that all actions taken under the account are in compliance with the organization’s policies and the laws governing its operations. 

4.5 Account Termination and Suspension 

Eventful Sunday reserves the right to suspend or terminate your User Account at any time if we have reason to believe that you have violated any of the Terms and Conditions, engaged in fraudulent activity, misused the platform, or posed a risk to the integrity of the platform or its users. Grounds for suspension or termination include, but are not limited to: 

• Violation of Terms: Any breach of the Terms, including but not limited to providing false information during registration, engaging in fraudulent transactions, or attempting to disrupt the functionality of the platform. 

• Unauthorized Access: If you or someone using your account attempts to gain unauthorized access to other users’ accounts, data, or Eventful Sunday’s backend infrastructure, your account will be terminated, and legal action may be pursued. 

• Misuse of the Platform: Repeated misuse of platform features, including ticket purchasing, refund abuse, or inappropriate behavior towards other users or Eventful Sunday staff, will result in account termination. 

Should your account be terminated or suspended, Eventful Sunday will make reasonable efforts to notify you of the reasons and, where possible, provide instructions for resolving the issue (e.g., resetting your password or correcting inaccurate information). However, Eventful Sunday is under no obligation to restore your access or refund any payments or credits tied to a suspended or terminated account. 

4.6 Reactivation of Accounts 

In certain cases, suspended or deactivated accounts may be eligible for reactivation. This depends on the nature of the violation and whether it can be resolved. For example, if your account was suspended due to inaccurate information, you may be able to update your details and request a review. If your account is reactivated, you agree to comply with any additional terms or conditions imposed by Eventful Sunday, which may include enhanced security measures or monitoring. 

4.7 Account Deletion and Data Retention 

If you wish to permanently delete your account, you can request this through your account settings and by filling out the google form for user and for organizer and we will be proceeding with the deletion of our account or you can also request a deletion of the account by contacting support@eventfullsunday.co.uk. Upon confirmation from our admin side, Eventful Sunday will deactivate your account and, where applicable, anonymize or delete personal information in accordance with our data retention policies, as outlined in our Privacy Policy. 

Please note the following regarding account deletion: 

• Event Participation: If you have purchased tickets to upcoming events, deleting your account may result in the cancellation of those tickets, and refunds will be processed based on the event Organizer’s policies.

• Business Interruption: Organizers are responsible for ensuring the proper management and delivery of their events. CubeQ Analytica is not responsible for any losses or damages caused by interruptions to business activities, such as venue issues, performer cancellations, or audience disruptions. 

11.1 Indirect, Incidental, and Consequential Damages 

CubeQ Analytica is not liable for any damages that are indirect, incidental, or consequential in nature. These types of damages may include (but are not limited to): 

• Lost Profits: Organizers acknowledge that ticket sales and event attendance may fluctuate due to factors outside of CubeQ Analytica’s control, and Eventful Sunday cannot be held responsible for any reduction in expected profits. 

• Inconvenience or Emotional Distress: Any emotional distress, inconvenience, or non-financial losses experienced as a result of canceled or rescheduled events are not covered under these Terms. 

• Attendee Behavior: CubeQ Analytica is not responsible for the actions or behavior of event Attendees or third-party participants. Any damages or liabilities caused by Attendees to property, the venue, or other individuals are the sole responsibility of the Organizer and Attendees involved. 

11.2 Maximum Aggregate Liability 

In any instance where CubeQ Analytica is found liable for direct damages, the maximum liability shall be limited to the amount paid by the User to CubeQ Analytica for access to the platform or the specific event that led to the claim. This limitation applies whether the claim is based on contract, tort, strict liability, or any other legal theory. If the claim is related to ticket purchases, CubeQ Analytica’s maximum liability is limited to the value of the ticket(s) purchased through the platform. 

12. Changes to the Terms

CubeQ Analytica reserves the right to modify, update, or revise these Terms and Conditions at any time. Changes to the Terms may be necessary due to evolving business needs, legal requirements, or improvements in the platform’s services and functionalities. 

12.1 Notification of Changes

While Eventful Sunday operates as a platform connecting Organizers and Attendees, disputes may arise between users of the platform. For example: 

• Attendees may dispute refund policies or event cancellations with Organizers. 

• Organizers may have contractual disputes with vendors or performers associated with their events. 

CubeQ Analytica is not a party to such disputes and does not mediate or resolve conflicts between users. However, CubeQ Analytica provides the necessary tools and communication channels for users to address these disputes themselves. If a legal dispute escalates to the point of litigation or formal ADR, the jurisdiction and governing law will be determined by the relationship between the users, the specific contracts in place, and the relevant laws of their locations.
